According to the ID Act of 1947 and its most recent revisions, no entity can keep you for more than 30 days’ notice; it is up to you to deal with them.
If they insist on serving the entire notice time, offer them the notice period buyout option for the short notice period; if you are unable to pay the sum, do not panic.
Simply serve a demand notice. Most organizations resolve the issue after receiving a demand notice because they do not want to engage in Labour Court proceedings for such trivial matters, knowing that they will face penalties for intentional or unintentional mental harassment of an employee.
